Terms & Conditions

2. Acceptance of Terms

By engaging Duskfen's services, submitting a contact form, or entering into a service agreement, you confirm that you have read, understood, and accept these Terms and Conditions. You must be at least 18 years of age and have the capacity to enter a binding agreement under Taiwan law.

3. Description of Services

Duskfen provides professional in-home care and assistance for elderly individuals across the Greater Taipei area. Services are available as described on our website and as confirmed in writing prior to commencement. Service availability is subject to caregiver availability and geographic coverage. We will communicate any limitations that apply to your specific situation before any agreement is finalised.

4. Service Delivery

Services are delivered by trained, vetted caregivers assigned by Duskfen's coordination team. We reserve the right to substitute caregivers when necessary due to leave, unavailability, or quality-related reassignment. Where a primary caregiver arrangement has been confirmed (as in Round-the-Clock service), we endeavour to maintain continuity but cannot guarantee it under all circumstances.

Clients are expected to provide a safe and respectful working environment for caregivers. Duskfen reserves the right to withdraw a caregiver from a placement if their safety or wellbeing is at risk.

Service fees are as stated on the Duskfen website at time of engagement:

Invoices are issued monthly. Payment is accepted via bank transfer and other methods agreed at onboarding. Late payment may result in temporary suspension of service. Pricing is stated in New Taiwan Dollars (NT$). Duskfen reserves the right to review pricing with reasonable advance notice to clients.

7. Changes and Cancellations

Clients may adjust or pause services with a minimum of five business days' written notice for regular service changes, and ten business days for cancellation of Round-the-Clock arrangements. Cancellations made with less notice may be subject to a partial billing charge for the notice period. Emergency situations will be assessed on a case-by-case basis with fairness and understanding.

8. Intellectual Property

All content on the Duskfen website โ€” including text, design, and structure โ€” is owned by Duskfen and may not be reproduced without written permission. Clients are granted a limited, non-exclusive right to access and use the website for their own personal, non-commercial purposes.

9. Disclaimers

Duskfen's caregivers are trained home care aides, not medical professionals. Our services do not constitute medical, nursing, or clinical care. Duskfen does not make specific promises about health outcomes for care recipients. Families should maintain appropriate medical supervision through qualified healthcare providers.

Our website is provided on an "as is" basis without warranties of any kind regarding accuracy, availability, or suitability.

10. Limitation of Liability

To the extent permitted by applicable law in Taiwan, Duskfen's liability to clients is limited to the value of the specific service fee paid in the relevant billing period. We are not liable for indirect, consequential, or incidental damages arising from service use. This limitation does not apply to liability arising from our own negligence or from circumstances governed by mandatory consumer protection provisions under Taiwan law.

11. Indemnification

You agree to indemnify Duskfen against claims, losses, or costs arising directly from your breach of these Terms, your misrepresentation of information, or your failure to provide a safe working environment for caregivers.

12. Termination

Either party may terminate a service agreement with appropriate notice as described in Section 7. Duskfen may terminate a service immediately if a caregiver's safety is compromised, if fraudulent information has been provided, or if payment obligations are significantly in arrears. Upon termination, outstanding amounts for services rendered remain payable.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of Taiwan (Republic of China). In the event of a dispute, both parties agree to first attempt informal resolution through direct communication. If a resolution cannot be reached, disputes will be referred to the competent courts in New Taipei City, Taiwan, as the governing jurisdiction.

14. Changes to These Terms

Duskfen may update these Terms from time to time. Updated versions will be published on our website with the revised effective date. Continued use of our services after that date constitutes acceptance of the updated Terms. We will make reasonable efforts to notify active clients of material changes in advance.
